In almost all cases in which Swiss bankers and advisors have appealed against the delivery of their data to US authorities the competent courts sided with them, i.e. the banks must not provide these data to the USA. The scope of employees that have taken action includes the whole range of Swiss bank employees that had some sort of contact of US clients in the past decade: young professionals that were asked to deal with the files of US clients in their first few weeks at the bank, fiduciaries setting up structures to manage assets for a bank client as well as the former head of private banking of a foreign bank in whose case the Zurich supreme court recently decided that his name must not be provided.
